I. Introduction

You are reviewing this Telehealth Informed Consent because you are seeking healthcare services (“Healthcare Services”) delivered via telehealth technologies by our affiliated professional organization(s) (“the Providers”), facilitated through the Hyve Wellness website, mobile app, or other telehealth technologies (collectively, the “Hyve Wellness Platform”).

This Consent does not supersede any Terms of Service, Privacy Policy, or Notice of Privacy Practices you have agreed to. Rather, it supplements those documents.

By creating an account, initiating a consult, clicking “I consent to telehealth,” checking a box to signify acceptance, or using another acceptance method on the Hyve Wellness Platform, you indicate you have reviewed and understand the risks described herein and consent to receiving services via telehealth. A record of this Telehealth Informed Consent will be maintained by your Provider. Your continued participation in telehealth services constitutes ongoing acceptance of this Consent and acknowledgment of the representations stated herein.

II. What Is Telehealth?

“Telehealth” is the delivery of health and wellness services through electronic communications, information technology, or other means between a healthcare professional located in one place and a patient in another. Telehealth can involve:

  • Asynchronous interactions (store-and-forward)
  • Synchronous video and audio in real-time
  • Interactive audio-only sessions

 

These telehealth services may be used for diagnosis, treatment, follow-up, or patient education. This Telehealth Informed Consent explains the treatment methods, risks, and limitations of using telehealth to meet your health and wellness needs.

III. Possible Benefits of Telehealth

  • Convenience: Telehealth may allow easier, more efficient access to medical care and follow-up.
  • Flexibility: You can often choose appointment times that work for your schedule.
  • Location Independence: Receive healthcare services without an in-office visit, if clinically appropriate.

IV. Possible Risks of Telehealth

  1. Incomplete Information: The information transmitted may be insufficient for your Provider to provide appropriate care.
  2. Technical Failures: The technology (hardware, software, internet) might fail or become unstable, potentially delaying your services. If a technical failure prevents communication, please contact us at 469-620-7123.
  3. Data Issues: In some instances, limited access to your medical records, or poor quality of transmitted data, could result in adverse drug interactions, allergic reactions, or clinical judgment errors.
  4. Limited Scope: Some conditions may not be suitable for telehealth, and your Provider may refer you for in-person evaluation.
  5. Diagnostic Testing Defects: Laboratory products or services may have defects that produce false negatives, false positives, or inconclusive results, impacting your Provider’s ability to accurately diagnose or treat you.

 

You may stop or decline Healthcare Services delivered via telehealth at any time. However, standard fees may apply if a medical consultation has already occurred. Your affiliated professional organization is not obligated to provide ongoing care if you discontinue services.

V. Patient Acknowledgments

By accepting this Telehealth Informed Consent, you acknowledge, understand, and consent to the following:

  1. Review of Risks & Benefits – You have carefully reviewed this Telehealth Informed Consent, understand its contents, and recognize there are benefits, risks, and limitations associated with telehealth. 
  2. Privacy Risks – You understand that telehealth services rely on electronic data transmission, which may increase privacy risks despite reasonable security measures. 
  3. Provider Credentials – Your Provider may be a physician, nurse practitioner, physician assistant, or other licensed healthcare professional authorized to deliver telehealth services. 
  4. Others Present – Individuals other than your Provider (e.g., technical staff, interpreters) may be present during the telehealth visit to assist in service delivery. You will be informed of their presence and role. 
  5. Accuracy of Information – You certify that any information you provide through the Hyve Wellness Platform is accurate, true, and complete to the best of your knowledge. 
  6. Store-and-Forward Consent – In some cases, your Provider may decide it is appropriate to deliver services asynchronously (“store-and-forward”). By continuing to use the Platform, you agree to receive Healthcare Services in this manner if determined clinically appropriate. 
  7. No Guarantee of Prescription – You understand that you may or may not receive a prescription based on your Provider’s clinical judgment. No outcome or improvement of your condition is guaranteed. 
  8. Technical Failures – Telehealth may suffer interruptions beyond the control of Hyve Wellness or your Provider. You agree to hold harmless Hyve Wellness and its affiliated professional organization(s) for delays or data loss due to such technical failures. 
  9. Diagnostic Testing Limitations – You understand that third-party laboratory products and services coordinated through the Hyve Wellness Platform may contain defects, produce erroneous results, or be otherwise limited, potentially affecting the quality or accuracy of care. 
  10. Scope of Services – The Hyve Wellness Platform may offer a specific set of healthcare services. Not all conditions or needs may be addressed. Your Provider reserves the right to deny treatment if telehealth is deemed clinically or ethically inappropriate. Hyve Wellness does not influence clinical decisions; Providers alone are responsible for the medical care and treatments they provide. 
  11. Communication Delays – Messages you send through the Hyve Wellness Platform may not be reviewed immediately. Delays can occur. You agree to check the Platform regularly for new messages from your Provider. 
  12. Right to Withdraw Consent – You can withdraw your consent for telehealth at any time. However, the Providers accessible through the Hyve Wellness Platform do not offer in-person treatment. Withdrawing consent may require you to seek in-person care from another provider. 
  13. Access to Records – You may access your health records relevant to telehealth services in accordance with applicable laws. You may grant your primary care provider permission to obtain these records, if desired. 
  14. Choice of Pharmacy or Lab – While the Hyve Wellness Platform may coordinate pharmacy or diagnostic lab services, you have the right to use the pharmacy or lab of your choice.

 15.Third-Party Beneficiary – You agree that Hyve Wellness (and any associated entities) is a third-party beneficiary of this Telehealth Informed Consent and may enforce it against you.
